ICE officer who shot Austin delivery driver lacked body camera, reports say

The Immigration and Customs Enforcement officer who shot 28-year-old Venezuelan delivery driver Wilber Rafael Garcés Pérez in Austin on Sunday was not wearing a body camera, CBS News reported, citing people familiar with the investigation.
Garcés Pérez was shot in the upper torso while working for DoorDash, according to local authorities and his attorney. Austin Police Chief Lisa Davis said ICE agents had pursued him before the shooting. Austin police released footage Tuesday from an off-duty officer’s dashboard camera and a responding officer’s body camera, but neither recording captured the events leading to the shooting. Davis and Mayor Kirk Watson said local officers were not involved.
Federal officials say Garcés Pérez is unlawfully in the United States and subject to a final deportation order. His attorney, Kate Lincoln-Goldfinch, says he was lawfully present with a work permit. A federal judge paused his deportation Tuesday.
After being hospitalized, Garcés Pérez was transferred to ICE custody and later returned briefly to a hospital before being taken back to the South Texas Detention Complex in Pearsall. Following a Wednesday visit by Rep. Greg Casar, Lincoln-Goldfinch said Garcés Pérez still had a bullet lodged in his body, had limited mobility on his left side and had a bleeding wound.
The officer joined ICE last year after serving with U.S. Customs and Border Protection, CBS News reported. Garcés Pérez’s attorney has called for agencies to release all available footage.
