Federal Judge Temporarily Halts Border Construction in Texas’ Big Bend Region

A federal judge on Friday temporarily halted the Trump administration’s border barrier and infrastructure construction in the Big Bend region of West Texas, including work in and near Big Bend National Park.

U.S. District Judge Kathleen Cardone barred the administration from building barriers or related infrastructure and from conducting construction or ground-disturbing activity in the region unless it complies with federal laws that the Department of Homeland Security had sought to waive. Cardone found that the plaintiffs were likely to succeed on at least one claim and faced serious, irreparable harm without an injunction.

The order followed a lawsuit by Friends of the Ruidosa church, the Center for Biological Diversity and river guide Billy Miller challenging DHS waivers of environmental and historic-preservation laws. Planned work included roads, vehicle barriers and other security infrastructure. Opposition had come from landowners, businesses, public-land advocates and politicians from both parties, citing potential harm to the national park, nearby communities and the regional economy.

Customs and Border Protection said it remained confident in its legal authority to secure the border while preserving the Big Bend landscape and was consulting with the Justice Department on its next steps. The Center for Biological Diversity called the injunction a victory but said it would continue seeking full restoration of environmental protections.
