Supreme Court seeks responses over Election Commission decision-making as protests continue

The Supreme Court on Monday sought responses within a week from the Election Commission and the Centre to a petition challenging how the poll panel under Chief Election Commissioner Gyanesh Kumar allegedly made decisions without the approval of its two other commissioners.

A Bench led by Chief Justice Surya Kant said Election Commission decisions must be unanimous or taken by majority, and that it presumed this procedure had been followed. The petition followed an Indian Express investigation reporting that Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi had formally objected 14 times in 10 months to decisions related to the special intensive revision of electoral rolls, saying some were made without their knowledge.

The case comes amid demonstrations demanding Kumar’s resignation. More than 700 protesters and political leaders were detained near Delhi’s Jantar Mantar during a protest on Friday and were later reportedly released. Authorities barricaded the area, suspended nearby internet services and closed entry and exit points at 12 Metro stations.

In Mumbai, police registered an FIR against Cockroach Janta Party founder Abhijeet Dipke, two convenors and more than 400 unidentified people after a Friday protest at Shivaji Park for which permission had been denied. Police said the case involved unlawful assembly and disobedience of a lawful order; no arrests had been made.

The campaign said it would march to Delhi and protest at Jantar Mantar on October 10 if Kumar does not resign. Separately, a journalist who accused a Delhi Police assistant commissioner of sexual harassment and manhandling while she covered a protest was detained again Monday, The Hindu reported.
