A federal judge is considering whether to continue blocking President Donald Trump’s ban on White House access for journalists from CNN, MS NOW and Politico while the outlets’ lawsuit proceeds.
U.S. District Judge Timothy Kelly extended an earlier temporary restraining order through Tuesday, allowing reporters from the three organizations to retain access to the White House complex. He said he expects to rule by then on their request for a preliminary injunction. A lawyer for the outlets said the ban affects 78 credentialed journalists.
At a Thursday hearing, the news organizations argued that Trump imposed the ban in retaliation for coverage he disliked, pointing to his public criticism of their reporting. Justice Department lawyer Michael Velchik said the outlets had failed to meet minimum professional standards and had published reports that put national security at risk.
Kelly questioned the apparent difference between Trump’s public statements, which focused on negative coverage, and the administration’s arguments in court. He also cited a 2020 federal appeals court ruling requiring fair notice and meaningful standards before the White House may suspend a journalist’s credentials for alleged misconduct.
In a Friday court filing, the Justice Department urged Kelly to reject longer-term relief. It argued that the president has the authority and responsibility to enforce minimum journalistic standards to safeguard national security information and that the bans are lawful under the First Amendment.
