The U.S. Department of Labor suspended Microsoft, Adobe and six IT services companies from the Permanent Labor Certification program on Thursday, halting new and pending applications involving the firms.
Labor Secretary Keith Sonderling named Cognizant, Infosys, Tata Consultancy Services, Wipro, HCL Technologies and Capgemini alongside Microsoft and Adobe. He said Microsoft and Adobe were suspended because of multiple active federal investigations.
PERM is a step in many employer-sponsored green-card cases. It generally requires an employer to demonstrate that no qualified and available U.S. worker can fill a position and that hiring a foreign worker will not adversely affect comparable U.S. jobs. The suspension does not itself revoke existing H-1B visas, green cards or work authorization.
Vice President JD Vance accused companies of under-advertising jobs to U.S. workers and singled out Microsoft, alleging that it used foreign-worker programs while laying off 6,000 employees in 2025. Microsoft disputed that characterization, saying most of its U.S. employees are Americans. The company said 80% of approximately 6,000 H-1B applications it submitted during the last fiscal year involved extensions or status changes for existing employees, rather than new hires.
Hours after the announcement, President Donald Trump awarded Microsoft CEO Satya Nadella the National Medal of Technology and Innovation. Trump did not address Microsoft’s hiring practices during the ceremony.
