U.S. Immigration and Customs Enforcement officers shot and wounded 28-year-old Oscar Belgal during an arrest operation in New York City’s Marble Hill neighborhood on Thursday, October 8, while his five-year-old son was in the back seat of his car. The child was unharmed.

ICE official Marcos Charles said officers boxed in Belgal’s car after he refused orders to get out. According to Charles, Belgal accelerated, struck two ICE vehicles and then drove toward officers, prompting them to fire because they believed they and the public were in danger. Homeland Security Secretary Markwayne Mullin said the officers identified themselves, were wearing activated body cameras and did not know the child was inside.

New York Mayor Zohran Mamdani said agents wearing construction-style vests and masks surrounded the vehicle before firing multiple rounds, adding that they could not reasonably be identified as ICE officers. Video from the shooting itself has not been released. New York police said their officers neither witnessed nor participated in the shooting; police body-camera footage shows them arriving afterward and taking Belgal to a hospital.

Federal officials described Belgal’s neck injury as superficial. One of his lawyers, Paige Austin, told a judge Friday that a bullet remained in his body. After his discharge from hospital, Belgal was transferred to federal detention outside New York. His lawyers appeared on his behalf at a Friday hearing.

The shooting prompted protests and demands from city and state officials for an investigation. Mamdani called for ICE enforcement operations in the city to end. Federal authorities said the number of officers who fired remains under investigation.
