Bollywood actor Imran Khan has challenged an order requiring him to leave India by October 28 after authorities accused him of violating immigration law by participating in a political protest in Mumbai.
Khan, a U.S. citizen who holds an Overseas Citizen of India card, filed a petition in the Bombay High Court on Saturday seeking to quash the Foreigners Regional Registration Office’s October 14 Leave India Notice. He also requested an immediate stay and protection from deportation, blacklisting, a lookout circular or action affecting his OCI status.
The notice followed Khan’s detention near August Kranti Maidan on October 10 during a protest demanding the resignation of Chief Election Commissioner Gyanesh Kumar over allegations concerning revisions to electoral rolls. India’s Election Commission has denied allegations of vote fraud.
Police said Khan joined the protest despite not being an Indian citizen. His petition argues that authorities treated him solely as an American national without properly considering his OCI status, which provides a legal basis for living in India. His lawyer has said no law or rule governing OCI cardholders prohibits participation in a protest.
Khan has maintained that he attended as a Mumbai resident, had no affiliation with an organization and did not incite protesters. The FRRO also issued a show-cause notice asking why his OCI registration should not be cancelled, according to The Express Tribune.
On Sunday, Khan’s uncle, actor-filmmaker Aamir Khan, met Maharashtra Navnirman Sena leader Raj Thackeray. The Indian Express reported that details of their meeting were not immediately known.
