Cockroach Janta Party co-convenors Saurav Das and Ashutosh Ranka withdrew their Delhi High Court petition challenging their judicial custody on Wednesday after the court agreed to hear the matter urgently, The Hindu reported.
The two were detained in mid-October in connection with a protest at Jantar Mantar against the Special Intensive Revision of electoral rolls. The Indian Express reported that they were arrested on October 14 for allegedly breaching security and entering the site, while Scroll.in placed their detention on October 13 and described the demonstration as a symbolic protest with the national flag after Jantar Mantar had been de-notified as a protest venue.
A Special Executive Magistrate extended their custody by two days on Monday, bringing the reported total to seven days. The order said their conduct did not inspire confidence and cited repeated calls for protests at the de-notified site.
Special Executive Magistrates exercise limited preventive powers intended to avert breaches of peace but cannot conduct criminal trials. Former Delhi High Court Justice S. Muralidhar told Scroll.in that preventive custody should not become punitive and criticised police officers acting as executive magistrates. A 2018 Delhi High Court ruling said custody under preventive-arrest provisions must not exceed seven days at one time and must be reviewed weekly.
