Mahmoud Khalil, a Columbia University graduate and pro-Palestinian activist, asked the U.S. Supreme Court on Monday to review an appeals court ruling that could allow the Trump administration to re-arrest and deport him.
Khalil’s lawyers also sought an immediate stay of the ruling by the Philadelphia-based 3rd U.S. Circuit Court of Appeals. That court held that federal immigration law prevented a federal district judge from ordering Khalil’s release from Immigration and Customs Enforcement custody, saying his detention should first have been challenged through immigration court.
Khalil’s attorneys argue that noncitizens must be able to bring federal court claims alleging that immigration detention was imposed in retaliation for speech protected by the First Amendment. “If the Trump administration can punish someone for their pro-Palestine speech, this or any future administration can punish anyone for any speech,” Khalil said Monday.
Khalil, an Algerian citizen born in a Palestinian refugee camp in Syria and a lawful permanent U.S. resident, was arrested in March 2025 and detained for more than three months before a federal judge ordered his release. The government has cited his involvement in 2024 campus protests and maintains that it acted within its authority.
A lower-court order currently prevents Khalil’s renewed detention while the Supreme Court considers the matter. He separately continues to challenge an immigration judge’s order directing his removal to Algeria or Syria.
