Supreme Court Keeps Block on Transgender Inmate Care Restrictions

The U.S. Supreme Court on Wednesday rejected the Trump administration’s request to immediately enforce restrictions on medical care and accommodations for transgender people in federal prisons, leaving a lower-court order blocking the policy in place while litigation continues.

The restrictions followed an executive order directing the Bureau of Prisons to prevent federal funds from being used to conform an inmate’s appearance to that of the opposite sex. The policy would halt gender-transition surgeries, phase out hormone therapy and end accommodations including makeup and wigs, while continuing mental health services.

Three transgender federal inmates challenged the policy in a proposed class-action lawsuit. U.S. District Judge Royce Lamberth ordered the government to continue treatment, citing evidence that untreated gender dysphoria can contribute to depression, anxiety and suicidal thoughts. A divided federal appeals court declined to lift his order.

The administration argued that the treatments created security concerns and could no longer be justified. Lawyers for the inmates said the government had not identified security problems linked to hormone therapy during the roughly three decades it has been available in federal prisons. Bureau of Prisons court filings said about 600 inmates received hormone therapy in 2025.

Justices Clarence Thomas and Samuel Alito said they would have allowed the restrictions to take effect. The court’s action does not resolve the underlying lawsuit.
