The Bombay High Court will hear actor Imran Khan’s challenge to an order requiring him to leave India by October 28, after authorities accused him of violating immigration law in connection with a protest in Mumbai.
The Foreigners Regional Registration Office issued the Leave India Notice on October 14, following Khan’s detention near a demonstration at August Kranti Maidan on October 10. Protesters were demanding the resignation of Chief Election Commissioner Gyanesh Kumar over the handling of electoral-roll revisions.
Khan, a U.S. citizen who holds an Overseas Citizen of India card, disputes the authorities’ account. His petition says he did not participate in or have organisational links to the protest and left after police told him the area was restricted. His lawyers called the notice unconstitutional, arbitrary and disproportionate, arguing that it was issued without a prior hearing and failed to account for his OCI status. Earlier reports quoted Khan as saying he had attended as a Mumbai resident and was not representing any organisation.
The court scheduled the case for October 26 despite his lawyer’s request for an earlier hearing because of the October 28 deadline. Khan is seeking an immediate stay and cancellation of the exit order.
The FRRO has also issued a show-cause notice asking why Khan’s OCI registration should not be cancelled. BJP leader Kirit Somaiya had complained to police that Khan, as a foreign citizen, violated the law by joining the demonstration.
