Hunter Foster, the Mississippi police officer who fatally shot 1-year-old Kohen Wiley during an alleged shoplifting pursuit, has resigned from the Senatobia Police Department.
The city’s board of aldermen accepted Foster’s resignation on Oct. 21, Mayor Greg Graves confirmed. The resignation took effect immediately. Graves did not say whether Foster had been asked to step down. Foster had been on administrative leave since shortly after the June 14 shooting.
The shooting occurred outside a Walmart in Senatobia after an employee reported that suspected shoplifters were fleeing. Officials alleged that Kohen’s mother and another woman stole diapers, though The Guardian reported that neither had been charged. Body-camera and surveillance footage released Thursday shows officers leaving the store and drawing their weapons as the women’s vehicle attempted to depart. Foster fired multiple shots, killing Kohen and injuring the driver.
The Mississippi Attorney General’s Office announced Monday that the officers’ use of force was justified and that no charges would be filed. Foster’s attorney, Martin Zummach, told The Associated Press that Foster had “no choice” but to shoot because the car was driving toward him.
Ben Crump, an attorney representing Kohen’s family, disputed that account, saying the driver was trying to flee and Foster’s actions were excessive. The family is seeking a federal investigation, and Crump has called for Foster to be decertified as a police officer.
