The Bombay High Court on Tuesday stayed an order requiring Bollywood actor Imran Khan to leave India by October 28, allowing him to remain in the country until his next hearing on November 2.
The court recorded the Union government’s assurance that no coercive action would be taken against Khan before the hearing and placed the Foreigners Regional Registration Office’s “Leave India Notice” on hold. Khan, a U.S. citizen who holds an Overseas Citizen of India card, challenged the notice as unconstitutional and arbitrary, arguing that he had not been given an opportunity to be heard.
The FRRO issued the notice after Khan’s alleged participation in an October 10 demonstration at Mumbai’s August Kranti Maidan demanding the resignation of Chief Election Commissioner Gyanesh Kumar. Police briefly detained Khan and other demonstrators that day. Authorities said his involvement breached rules governing foreign nationals’ participation in political protests.
Khan’s petition denies that he participated in or mobilized the protest. His lawyer has also argued that no law or rule governing OCI cardholders prohibits joining a demonstration. Khan said at the scene that he was there as a Mumbai resident and was not representing any organization.
The action against Khan followed a complaint by Bharatiya Janata Party leader Kirit Somaiya, who alleged that Khan could not participate because he is not an Indian citizen.
