A federal grand jury in Washington on Tuesday declined to indict former White House aide Cassidy Hutchinson over testimony she gave to the House committee investigating the Jan. 6, 2021, attack on the U.S. Capitol.

A Justice Department lawyer, Neville Hedley, told a federal magistrate judge that the grand jury had not approved a proposed indictment, without identifying its subject. Multiple news organizations, citing people familiar with the proceedings, identified Hutchinson as the person prosecutors had sought to charge. The Justice Department’s Civil Rights Division handled the investigation, CBS News reported.

The precise allegations presented to the grand jury were not immediately clear. CNBC, citing MS NOW, reported that prosecutors sought a charge based on claims that Hutchinson made false statements. Republican lawmakers had accused her of lying under oath and reportedly referred the matter to the Justice Department.

Hutchinson, a former top aide to White House chief of staff Mark Meadows, testified in 2022 that Donald Trump and Meadows had been warned that some supporters were armed on Jan. 6. She also recounted being told by then-deputy chief of staff Tony Ornato that Trump lunged toward the steering wheel of his vehicle after the Secret Service refused to take him to the Capitol. Trump’s driver later contradicted that account in sworn testimony, saying Trump did not try to grab the wheel.
