Cockroach Janta Party co-convenors Saurav Das and Ashutosh Ranka have approached the Delhi High Court after a Special Executive Magistrate extended their judicial custody by two days on Monday. The High Court is likely to hear their petition on Wednesday, October 21.
Delhi Police detained the two activists on October 13 after they allegedly climbed over a locked gate to enter Jantar Mantar, which had been removed as a designated protest site. They displayed the national flag and protested against Chief Election Commissioner Gyanesh Kumar before being placed under preventive arrest. A third campaign leader, Ajinkya Shinde, was released on a personal bond.
Special Executive Magistrate Ritu Raj cited concerns that Das and Ranka could disturb public peace, saying their conduct indicated a lack of respect for the law. The magistrate also rejected sureties offered for the activists, citing identity discrepancies, insufficient knowledge of Das and doubts that the guarantors could ensure their appearance in court. Fresh sureties were ordered.
Lawyers for Das and Ranka opposed further detention and said the alleged conduct would not recur. In their High Court petition, the activists argue that their continued detention violates legal procedure and their right to personal liberty under Article 21 of the Constitution. They contend that protesting at a denotified site raises, at most, a regulatory issue and does not establish a proximate threat to public order.
