Democratic Rep. Ilhan Omar is challenging the legality of an early-morning federal search of her Washington-area home conducted Monday as part of an immigration fraud investigation.
In a Friday letter to Justice Department prosecutors, Omar’s attorneys called the investigation politically motivated and demanded the return of property seized by agents. Multiple reports said the seized items included her phone, computers and passport. Her lawyers also requested preservation of all audio and video recordings of the search.
According to CNN, a federal magistrate judge authorized the warrant while establishing procedures intended to protect congressional materials. Omar’s attorneys alleged that investigators failed to comply with those requirements, including protections under the Constitution’s Speech or Debate Clause. The Justice Department has described the operation as part of an ongoing federal criminal investigation but has not publicly detailed its basis.
The inquiry reportedly concerns possible false statements in documents connected to Omar’s naturalization. Omar, who fled Somalia with her family and arrived in the United States in 1995, became a citizen in 2000. Her attorneys said there is no legitimate basis to claim she violated citizenship laws, while Omar’s office said she had done nothing wrong.
President Donald Trump said he had “nothing to do with” the search. Illinois Rep. Delia Ramirez cited the raid while introducing legislation that would abolish the Department of Homeland Security and Immigration and Customs Enforcement and create a Department of Community Safety.
